Privacy Policy

This Privacy Policy (this "Policy") describes how WinningRealtors, LLC ("WinningRealtors," the "Company," "we," "us," or "our") collects, uses, discloses, and protects information in connection with our websites (including winningrealtors.com and its subdomains), our platform, and our products and services, including AI-powered real estate websites, CRM tools, marketing automation, social media management, and AI voice and chat assistants (collectively, the "Services").
By accessing or using the Services, submitting information to us, or communicating with us or with our AI assistants, you acknowledge that you have read and understood this Policy and agree that your information may be collected, used, and shared as described herein. If you do not agree with this Policy, please do not use the Services.
This Policy is incorporated into, and forms part of, our Terms & Conditions. Capitalized terms used but not defined in this Policy have the meanings given in the Terms & Conditions.
1. Scope of This Policy
This Policy applies to information we collect: (a) on our own websites and marketing channels; (b) through our platform when used by our business customers ("Clients"); (c) through phone calls, text messages, chats, and emails with us or with our AI assistants, including our AI voice agent ("Wynn"); and (d) from third-party sources as described below.
This Policy does not apply to websites, products, or services operated by third parties, even if linked from the Services, or to the independent data practices of our Clients. Where we host websites, communication tools, and CRM systems on behalf of Clients, the Client — not WinningRealtors — determines why and how the personal information of its own leads and customers is collected and used; in those situations we act as a service provider processing information on the Client's behalf and under the Client's instructions, and individuals should direct privacy inquiries to the applicable Client. See the section titled "Information We Process for Our Clients" below.
2. Information We Collect
We collect the following categories of information:
- Information you provide directly, such as name, email address, phone number, company or brokerage name, mailing address, real estate license information, and the contents of messages, forms, surveys, reviews, and support requests you submit.
- Account and billing information, such as login credentials, subscription and plan selections, and payment details (payment card numbers are collected and processed by our third-party payment processors, and we do not store full card numbers).
- Communications data, including emails, text messages, chat transcripts, call logs, voicemails, and, as described below, recordings and transcriptions of phone and voice interactions.
- Usage and device information collected automatically, such as IP address, browser type, device identifiers, operating system, pages viewed, links clicked, referring URLs, session duration, and interactions with emails and campaigns (such as opens and clicks).
- Behavioral and property-interest data generated through the Services, such as properties viewed, saved searches, inquiry history, engagement patterns, and lead scores or intent signals derived from that activity, including signals generated by artificial intelligence.
- Information from third parties, such as data from MLS/IDX feeds, social media platforms you connect, analytics providers, advertising partners, data-enrichment services, and publicly available sources.
3. Call Recording, Monitoring, and AI Processing
The Services include AI-powered voice and chat assistants. When you call, are called by, or otherwise interact with the Services by voice or chat, your call or conversation may be answered or conducted in whole or in part by artificial intelligence rather than a human, and MAY BE RECORDED, MONITORED, TRANSCRIBED, ANALYZED, AND PROCESSED BY AUTOMATED SYSTEMS, including AI and machine-learning technologies, for purposes such as answering questions, qualifying inquiries, booking appointments, logging interactions to the applicable CRM, quality assurance, training, security, fraud prevention, dispute resolution, and improving the Services.
By continuing with a call or conversation after any notice or prompt, or by initiating contact with the Services, you consent to such recording, monitoring, transcription, and AI processing to the fullest extent permitted by applicable law. If you do not consent, your option is to end the call or conversation and contact us by another means, such as email.
AI assistants can make mistakes. Responses generated by our AI assistants are automated, may be inaccurate or incomplete, and do not constitute legal, financial, or professional advice or a binding commitment by WinningRealtors or by any Client. Please verify important information with a human representative.
4. How We Use Information
We use the information we collect, alone and in combination, for purposes including:
- Providing, operating, personalizing, maintaining, and supporting the Services, including hosting Client websites, routing and answering communications, matching property interests, scheduling appointments, and syncing data to CRM systems.
- Operating, training, testing, fine-tuning, and improving our Services and features, including our AI models, prompts, automations, and workflows, using data in identified, de-identified, or aggregated form as we determine appropriate.
- Processing payments, managing subscriptions, measuring usage against allocations and limits, and enforcing our Terms & Conditions.
- Communicating with you about the Services, including service announcements, administrative messages, and — where permitted by law — marketing and promotional communications, from which you may opt out as described below.
- Analytics, research, and product development, including understanding how users interact with the Services and measuring campaign performance.
- Marketing our own business, including as described in the Publicity provisions of our Terms & Conditions.
- Security, fraud prevention, debugging, backup, and disaster recovery.
- Complying with legal obligations, enforcing our agreements, and establishing, exercising, or defending legal claims.
We may create and use de-identified or aggregated data for any lawful purpose, and such data is not subject to this Policy so long as it is not re-identified.
7. Data Retention
We retain information for as long as we consider it reasonably necessary for the purposes described in this Policy, including providing the Services, complying with legal, accounting, and reporting obligations, resolving disputes, enforcing our agreements, maintaining backups, and supporting business operations. Retention periods vary by data type and context and are determined in our discretion consistent with applicable law. We may retain de-identified or aggregated data indefinitely. Following termination of a Client account, we may delete hosted data in accordance with our Terms & Conditions and ordinary data-management practices, and we are not obligated to retain data for any particular period.
8. Security
We use commercially reasonable administrative, technical, and physical safeguards designed to protect information under our control. However, no method of transmission over the internet or method of electronic storage is completely secure, and we cannot and do not guarantee the security of any information. You transmit information to us at your own risk, and you are responsible for safeguarding your own account credentials. To the fullest extent permitted by law, we disclaim liability for unauthorized access, use, alteration, or destruction of information resulting from events beyond our reasonable control.
9. Information We Process for Our Clients
When we host websites, phone lines, messaging, CRM, and marketing automation on behalf of a Client, the leads, contacts, communications, and related records generated through those tools are collected on behalf of that Client, and the Client is responsible for its own privacy practices, notices, and compliance with laws applicable to its collection and use of End User information, including obtaining any consents required for calls, texts, recordings, and AI-assisted interactions.
If you are an End User of a Client and wish to access, correct, or delete information held about you, please contact the applicable Client directly. We will reasonably cooperate with our Clients, as their service provider, in responding to verified requests as required by applicable law. We are not responsible for a Client's failure to honor any request or to comply with applicable law.
10. Your Privacy Choices and Rights
Marketing opt-out. You may opt out of our marketing emails by using the unsubscribe link in those emails, and out of marketing text messages by replying STOP. We may continue to send transactional and service-related communications, which are not marketing.
Access, correction, and deletion. Depending on your jurisdiction, you may have rights to request access to, correction of, deletion of, or a copy of personal information we hold about you, or to object to or restrict certain processing. We will honor verified requests to the extent required by applicable law. We may need to verify your identity before acting on a request, may deny requests where an exception applies, and may retain information as permitted or required by law. We will not discriminate against you for exercising rights available to you under applicable law.
To submit a request, contact us at [email protected] with sufficient detail for us to understand and verify the request. If you are an End User of one of our Clients, please direct your request to that Client as described above.
11. Children's Privacy
The Services are business tools intended for adults and are not directed to children under the age of eighteen (18). We do not knowingly collect personal information from children under eighteen. If you believe a child has provided personal information to us, please contact us at [email protected] and we will take reasonable steps to delete it.
12. Third-Party Websites and Services
The Services may contain links to, or integrate with, third-party websites, platforms, and services, including MLS/IDX providers, social media platforms, scheduling tools, and video services. We are not responsible for the content, policies, or practices of any third party. Information you provide to third parties is governed by their privacy policies, which we encourage you to review.
13. United States Processing; International Users
The Services are operated from the United States, and information we collect is stored and processed in the United States and in other jurisdictions where we or our service providers operate. Data protection laws in these jurisdictions may differ from those of your place of residence. If you access the Services from outside the United States, you acknowledge and agree that your information will be transferred to and processed in the United States and other jurisdictions as described in this Policy.
14. Changes to This Policy
We may update this Policy at any time in our discretion. When we do, we will post the revised Policy on this page and update the effective date above. Changes take effect immediately upon posting, and we have no obligation to provide individual notice of changes, though we may choose to do so for material changes. Your continued use of the Services after a revised Policy is posted constitutes your acceptance of the revised Policy. Please review this Policy periodically.
